Getting threatened with eviction
Dec. 8th, 2006 08:06 pmI arrived home this evening to find a letter from my landlord, better known as _____ Housing LLC, in my mailbox. It said that I am "in default" of rent for the month of December, and that I now owe them the full amount of this month's rent plus 10% as a late fee. That adds up to about $500 (US). The letter goes on to say that if the rent + late fee is not paid "five (5) days from this date of notice,...an immediate lawsuit will be filed against [me] to collect said rent and recover possession of premises."
I assume "recover possession of premises" = EVICTION. For my building, rent is due on the 1st of each month, with a grace period of 5 days. The letter is dated December 6, 2006, which means I have to pay by Monday, December 11, 2006, or Hit the Road, Jack.
Well, I would think this is fair, except for three things:
1) I've already paid rent for December 2006.
2) Not only that, I paid it early, over Thanksgiving weekend. I distinctly remember going to their office, and sliding an envelope with a check through the mail slot.
Now I realized that they could have misplaced my check or maybe I really had not paid and just thought I did, so I went to my bank's website to see what my statement had to say, only to find out that:
3) They have already cashed my check!!!
According to the bank website, it was cashed on November 28, 2006. So why are these people accusing me of not paying and threatening to boot me out of my home?
Since my undeserved deadline is Monday, it means that I have to go to the bank first thing tomorrow morning and ask if I can get proof of my cashed check. While I am at it, maybe I should get proof of every check I have written to them since moving in so that they can't accuse me of skipping a month. That means I'll be late to Habitat for Humanity tomorrow. Also, since the housing office is closed on weekends, and open on the weekdays at the same time I have to be at work, I am going to have to take off work on Monday to defend myself. Goody.
